Terms of Service

1. Acceptance of Terms

By accessing or using the Lease Tab platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding agreement between you ("Customer" or "you") and Lease Tab ("we", "us", or "our").

2. Description of Service

Lease Tab provides an AI-powered leasing operating system that includes an AI receptionist for apartment communities, lead management, prospect engagement campaigns, property management software integrations, and related analytics. The Service is offered in Starter, Portfolio, and Enterprise tiers, each with a one-time setup fee and recurring subscription pricing.

3. Account Registration

• You must provide accurate and complete information when registering
• You are responsible for maintaining the security of your account credentials
• You must be authorized to represent the property management company you register
• One account per organization; additional seats may be available per your plan

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any law
• Transmit spam, unsolicited marketing, or content that violates CAN-SPAM or similar regulations
• Attempt to access data or accounts that are not yours
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the AI features to generate misleading, discriminatory, or harmful content
• Interfere with or disrupt the Service or servers hosting it

5. Subscriptions and Billing

• Pricing is based on the selected tier and number of units managed
• A one-time setup fee is charged at onboarding and is non-refundable
• Recurring subscription fees are billed monthly or annually as selected
• You may upgrade or downgrade your plan at any time; changes take effect the next billing cycle
• Unless required by law, paid fees are non-refundable
• We may adjust pricing with at least 30 days' notice before the renewal date

6. AI Features and Call Handling

The Service includes AI-driven call handling, email drafting, and outreach campaign features. You acknowledge that AI-generated content may not always be accurate and that you are responsible for reviewing and approving AI-drafted communications before they are sent on your behalf. Call recordings and transcripts are processed to improve lead management and may be stored for the duration of your subscription.

7. Intellectual Property

The Service, including its software, design, content, and branding, is owned by Lease Tab and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription.

Content you upload, including property listings and prospect data, remains yours. By using the Service, you grant us a license to process that content solely to provide the Service to you.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You are responsible for ensuring you have the necessary rights and consents to process prospect and resident data through the Service, including compliance with applicable privacy laws such as CCPA and GDPR.

9. Service Availability

We strive for 99.99% uptime but do not guarantee uninterrupted service. We are not liable for downtime caused by factors outside our control, including third-party integrations, network issues, or scheduled maintenance. We will provide reasonable notice for planned maintenance.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be error-free, secure, or available at all times. AI-generated outputs are provided for convenience and should be reviewed before use.

11. Limitation of Liability

To the maximum extent permitted by law, Lease Tab shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the event.

12. Indemnification

You agree to indemnify and hold harmless Lease Tab from claims, damages, and expenses arising from your misuse of the Service, violation of these Terms, or infringement of third-party rights through content you provide.

13. Termination

You may cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms or fail to pay fees when due. Upon termination, your right to use the Service ends immediately. We will provide a reasonable opportunity to export your data before account deletion.

14. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any disputes will be resolved in the courts located in Texas.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or a notice within the Service. Continued use after the effective date constitutes acceptance of the updated Terms.
